ALTERNATIVE DISPUTE RESOLUTION ("ADR") AND CONFIDENTIALITY
|
A key feature of all types of alternative dispute resolution is confidentiality. Discussions held during a mediation or arbitration are entirely confidential. This is a key factor in promoting the preservation of relationships and the preservation of reputations.
Unlike court where once a complaint is filed it is open to public viewing, alternative dispute resolution methods focus on the privacy of the parties involved. A confidentiality agreement is also entered into prior to any negotiations to ensure such safety. |
Who We Are |
CANNA COURT was founded as an effort to meet the needs of cannabis companies for a cost-effective, consistent and effective way to resolve disputes amongst themselves. Today the company is based in Manhattan, New York and aims to become the go-to alternative dispute resolution service provider to the Cannabis industry.
CANNA COURT hears cases involving Cannabis Business disputes, Intellectual Property disputes, Licensing disputes, Management Agreement disputes, Exclusive Agreement disputes, Non-Compete and Non-Circumvent disputes as well as any and all other matters related to the cannabis and hemp industries. Membership in CANNA COURT is gained through a brief application; there is currently no fee. |
Membership |
Membership in CANNA COURT is very beneficial to cannabis companies, the entire cannabis industry, as well as the legal system. Membership is currently free and will save members untold amounts in litigation costs. Courts are not clogged with myriads of cases between cannabis companies. Cases may be filed online and turnaround is very quick; usually within a few months. Courts have been reluctant to hear any cannabis business-related matters, and for good reason. They simply are ill equipped to stay on top of the ever changing dynamics and complexities of the cannabis industry. CANNA COURT members obtain arbitration and mediation services at discounted rates.
|
Our Panelists |
The members who hear these cannabis disputes for CANNA COURT and make decisions are called “Panelists”. Panelists must have at least ten (10) years of recent litigation, transactional, judicial or ADR experience and pass certification tests related to the Cannabis industry, and the type of cases they want to qualify to hear. They receive regular updates on current cannabis-related laws and have a vast array of resources available to them through both the CANNA COURT and their own networks and employers. Panelists are not permitted to make decisions on cases that involve cannabis companies that they are affiliated with without consent from all parties.
